Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DrCalims wellness assessment platform (the "Service") operated by Dr Calim's Wellness Centre ("DrCalims", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and the terms "you" and "your" refer to both you and that organisation.

The Service uses Google APIs, including Google Sign-In (OAuth 2.0), to provide authentication. Your use of Google APIs through the Service is also subject to the Google API Terms of Service and the Google APIs User Data Policy, including the Limited Use requirements.

We do not use Google API data to serve personalised advertising. We do not transfer Google API data to any third party for the purpose of serving personalised advertising. We only request Google API scopes that are necessary for the Service to function.

DrCalims is an independent service provider and is not affiliated with, endorsed by, or sponsored by Google LLC. All Google trademarks, service marks, and brand features are the property of Google LLC and are used in accordance with Google's Branding Guidelines. Google has no responsibility or liability for the Service or these Terms.

You may revoke DrCalims's access to your Google account at any time through your Google Account security settings. Discontinuing use of Google Sign-In does not automatically close your DrCalims account; to close your account, contact us using the details in the "Contact Us" section.

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding agreement.

If you are a practitioner or clinic administrator, you represent that you are authorised to access and manage client health data within your clinic and that you will comply with all applicable healthcare and privacy regulations.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account or any other security breach.

You agree to provide accurate and complete information when creating your account and to keep your account information up to date. We reserve the right to suspend or terminate accounts that provide false or misleading information.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Service in any way that violates applicable laws or regulations; misuse the Service by introducing viruses, malware, or other harmful code; attempt to gain unauthorised access to other users' data, systems, or networks; interfere with or disrupt the Service or servers; use the Service to store or transmit defamatory, infringing, or unlawful content; or reverse engineer, decompile, or disassemble any part of the Service.

DrCalims provides wellness assessments and lifestyle recommendations for general wellness purposes only. The Service does not provide medical diagnosis, treatment, or advice. Always consult a qualified healthcare professional before making decisions about your health.

By using the Service, you consent to the collection, storage, and processing of your health assessment data as described in our Privacy Policy. You acknowledge that wellness assessments involve the collection of sensitive health information.

If you are a practitioner or clinic administrator, you warrant that you have obtained all necessary consents from your clients before entering their data into the Service, and that your use of the Service complies with all applicable privacy and healthcare regulations.

The Service, including its content, features, and functionality, is owned by DrCalims and is protected by copyright, trademark, and other intellectual property laws. The DrCalims name, logo, and brand features are our property and may not be used without our prior written consent.

You retain ownership of the health and personal data you submit to the Service. You grant DrCalims a non-exclusive, royalty-free licence to use, store, and process your data solely for the purpose of providing and improving the Service.

The Service integrates with third-party services, including Google APIs for authentication. DrCalims is not responsible for the practices or content of third-party services. Your use of third-party services is subject to their respective terms and policies.

We may modify or discontinue third-party integrations at any time without prior notice, provided that any such change does not materially degrade the core functionality of the Service.

Some features of the Service may require payment. If you purchase a paid service, you agree to pay the applicable fees as displayed at the time of purchase. All fees are non-refundable except where required by law.

We may change our fees at any time. We will provide notice of any fee changes before they take effect. Continued use of the Service after a fee change constitutes acceptance of the new fees.

You may stop using the Service at any time. You may request deletion of your account and personal data by contacting us using the details in the "Contact Us" section.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, all licences granted to you under these Terms will cease immediately.

Sections of these Terms that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitations of liability, and governing law.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Wellness assessments and recommendations provided by the Service are for general informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. You should always seek the advice of a qualified healthcare provider with any questions about a medical condition.

We do not warrant that the results of any wellness assessment will be accurate or reliable. Individual results may vary.

To the maximum extent permitted by law, DrCalims and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.

Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you paid us for the Service in the twelve months preceding the claim, or one hundred Australian dollars (AUD $100) if you have not paid any fees.

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

We may modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
